Man’s Estate Files GranuFlo Lawsuit Following His Death

According to the Madison-St. Clair Record, a New York woman has filed a lawsuit against Fresenius Medical Care after one of her relatives died following a dialysis treatment.

The lawsuit was filed in St. Clair County Circuit Court. The woman, Janice Hill, is the administrator of the estate of Lymidis Hill, who used the dialysis product GranuFlo, a treatment for patients with late-stage kidney failure.

After using a GranuFlo machine on February 1, 2012, Hill reportedly suffered a sudden cardiopulmonary arrest and a heart attack, leading to his death. His estate has filed a lawsuit against Fresenius Medical Care North America Inc., Fresenius Medical Care Holdings Inc., Fresenius USA Manufacturing Inc., Fresenius USA Marketing Inc., and Fresenius USA Sales Inc.

Ms. Hill claims Fresenius failed to “properly design and test GranuFlo, sold GranuFlo while it was in a defective condition, sold GranuFlo when it was not fit for its ordinary purpose and failed to warn purchasers and users of GranuFlo’s defective condition.”

Last year, the Boston Business Journal (BBJ) reported that a study done by Fresenius evaluating patients in 667 dialysis centers revealed that patients were six to eight times more likely to suffer sudden cardiac death if they had elevated bicarbonate levels stemming from product usage.
