Second Jury Trial Awards Multi-Millions in Transvaginal Mesh Case

Transvaginal mesh implants have harmed thousands of women across the country. The second of many transvaginal mesh lawsuits recently concluded with a jury awarding the plaintiffs, an injured woman and her husband, $3.35 million in compensatory damages and $7.76 million in punitive damages. The South Dakota woman testified at trial about her extreme pain and debilitating injuries after the transvaginal mesh was surgically implanted in her body. She claimed that her life was a “living hell,” and that the mesh manufacturer was using women as “guinea pigs.”

The jury found that defendants Johnson & Johnson and its subsidiary, Ethicon, knew the mesh was prone to complications and failed to adequately warn implanting surgeons of such dangers. The jury also found that the defendants intentionally committed fraud against the plaintiffs and misrepresented the product in its brochures to doctors.

During the first transvaginal mesh trail, a California jury determined that another injured transvaginal mesh recipient and her husband were entitled to a total of $5.5 million in medical expenses, pain and suffering and other damages.

The Dangers of Transvaginal Mesh

Women implanted with transvaginal mesh have experienced profound pain, scarring, severe infections and puncturing of surrounding organs from the implants’ rough edges. Others have experienced serious erosion of the implant beneath the walls of the vagina. Beyond these horrific side effects, surgeons have difficulty removing the implants, as the mesh is deeply embedded into patients’ bodies. In addition to the ongoing pain, bodily injuries, medical bills and loss of income, these women also experience extreme emotional suffering, as their own lives and those of their families can be impacted forever.

The transvaginal mesh lawsuits are now being consolidated into multidistrict litigation in the Southern District of West Virginia, and four bellwether cases have been selected. The first case will be tried on June 11, 2013, with more following.
