Johnson & Johnson Lawsuit Settlement Announcement: $2.75 Billion Compensation for Plaintiffs’
The DePuy ASR MDL has reached a point of settlement for many plaintiffs. On Tuesday, November 19th, the parties announced a resolution for ASR patients who were revised before August 31, 2013. For the past three years, ZK’s Michelle Kranz, has served as the Court appointed Liaison Counsel for this litigation. On an almost daily basis, she has been actively engaged in the development of the DePuy ASR litigation. Her primary duties included providing information on the litigation to over 1,000 law firms from around the country. She also took several depositions of regulatory witnesses, was a part of the MDL Bellwether trial team and was most recently appointed by Judge David A. Katz to serve on the Plaintiffs’ Settlement Oversight Committee.
The basic settlement details are as follows:
- $2.475 billion compensation for the plaintiffs that had revision surgery as of August 31,2013
- Medical costs related to the hip replacement are to be covered by DePuy
- $250,000 is the base award for each patient revised before August 31, 2013
The division of Johnson & Johnson, DePuy Orthopaedics Inc., created a metal on metal hip implant that caused patients severe pain and injury. The hip replacement is known as ASR.
The base compensation is $250,000 but there are other factors that may increase or decrease a plaintiffs’ compensation.
Reduced compensation if patient:
- Smoking at the time of implant
- BMI (Body Mass Index) above 35
- ASR as revision device
- Length of use
- Death unrelated to revision
Increased compensation may be available if patient:
- Bilaterals (ASR hip on both sides and revised)
- If revision surgery did not work
- Death from revision surgery
- Myocardial Infraction
- Stroke
- Pulmonary embolism
- DVT
- Dislocation
- Foot drop
- Infection
During the settlement agreement all of the lawyers and judges were complimentary of the cooperative efforts of Plaintiffs’ attorneys from across the country. The team effort put forth by the Plaintiffs’ attorneys are in direct correlation with the opportunity presented to the patients. All of the plaintiff attorneys mentioned that they will continue to work on behalf of the patients who have not had revision surgery or who were not yet revised as of August 31, 2013, as their claims will not be affected by this agreement.
