According to Bloomberg, Johnson & Johnson’s DePuy unit is currently involved in its first trial over allegations that its metal-on-metal Pinnacle hip replacements caused particles to enter patient bloodstreams.
Last year, Johnson & Johnson set aside $2.5 billion for injury claims relating to 8,000 hip replacements from a different product line. More than 6,000 pending Pinnacle lawsuits were consolidated before U.S. District Judge Ed Kinkeade in Dallas.
The first lawsuit involves Kathleen Herlihy-Paoli, who allegedly suffered a cobalt-and-chromium material infection and was forced to have her artificial hips removed. The Herlihy-Paoli trial is important, as Bloomberg noted; it will set the tone for the other cases. If the jury awards a substantial verdict, it is possible that Johnson & Johnson could enter into settlement negotiations.
The Pinnacle device was not among Johnson & Johnson’s $2.5 billion settlement over claims against its ASR hip devices, which were also linked to metal poisoning and death. Those claims are being separately processed.
