Texas Woman Awarded $1.2 Million For Transvaginal Mesh Injuries

According to Bloomberg News, a Texas jury has ordered Johnson & Johnson to pay $1.2 million to a woman who was injured by one of the company’s vaginal mesh implants made to treat incontinence.

Jurors in Dallas awarded Linda Batiste, 64, $1.2 million in compensatory damages after it concluded that her TVT-O mesh sling implant injured her. The device reportedly eroded inside her.

Johnson & Johnson is currently facing more than 12,000 lawsuits nationwide over its subsidiary Ethicon’s transvaginal mesh products. The products have been linked to organ damage and have reportedly made sexual intercourse problematic and painful for recipients. Many of the cases have been consolidated in a federal court before a judge in West Virginia.

The U.S. Food and Drug Administration (FDA) has ordered Johnson & Johnson, as well as C.R. Bard Inc. and 31 other vaginal-implant makers to study rates of organ damage and complications after courts were bombarded with lawsuits.

Johnson & Johnson said it planned to appeal the verdict in Ms. Batiste’s case. In the meantime, Johnson & Johnson and Ethicon still sell the TVT-O device on the marketplace.

What Should I Do If I Have Been Injured By a Transvaginal Mesh Implant?

It is sad that so many women are suffering because of defective transvaginal mesh implants. Last December, Johnson & Johnson’s Ethicon subsidiary was accused of destroying documents for federal multi-district transvaginal mesh litigation.

If a transvaginal mesh product has injured you, you can contact our defective medical device attorneys. In 2010, 300,000 women had pelvic organ prolapse surgery, with transvaginal mesh products used in about a third of all procedures.

C.R. Bard, Endo Health Solutions, Boston Scientific and Cook Medical Systems have already announced settlements; however, Johnson & Johnson has refused to join settlement talks.
