Bloomberg News reported last week that C.R. Bard Inc. has been ordered to pay $2 million to a woman who alleged that the manufacturer hid flaws associated with its vaginal-mesh implants.
Jurors in Charleston, West Virginia deliberated for about 12 hours over the course of two days, according to Bloomberg News, holding Bard liable for injuries sustained by Donna Cisson, who claimed that its Avaulta line of products hurt her. Cisson was awarded $250,000 in compensatory damages and $1.75 million in punitive damages.
It was the first federal trial over injury claims relating to Bard’s transvaginal mesh devices. Currently, Bard faces 8,000 other claims over its Avaulta devices, which have led to alleged mesh erosion, organ perforation, pelvic organ, prolapse (POP) and injuries resulting in further surgeries.
There are also thousands of women involved in Multi-District Litigation (MDL) against a number of other transvaginal mesh manufacturers including Johnson & Johnson (JNJ), Ethicon, Inc., American Medical Systems, Inc. (AMS) and Boston Scientific Corp. (BSX).
Cisson’s case sets a benchmark for future cases. Women injured by vaginal-mesh implants can seek damages for pain and suffering, lost of income and loss of spousal consortium. Last spring, a South Dakota woman was awarded $3.5 million after Johnson & Johnson failed to warn her about the dangers relating to her vaginal mesh implant, which caused her mesh erosion, scar tissue and inflammation.
