Updating a story we brought you earlier this year: unfortunately, a federal judge in Louisiana has reduced the amount of damages awarded in an Actos product liability case from more than $9 billion to $38.1 million.
There are thousands of lawsuits pending across the country against Actos’ manufacturer, Takeda, over the drug’s links to bladder cancer. In 2011, the US Food and Drug Administration (FDA) announced that the use of Actos for more than one year might be associated with an increased risk of bladder cancer.
The $9 billion verdict was awarded in April to a New York man after jurors in the U.S. District Court for the Western District of Louisiana found that Takeda and Eli Lilly concealed the cancer risks associated with the drug.
While the reduction in damages is unfortunate, it was not unexpected that the drug makers would challenge the amount. Fortunately, the judge who reduced the damages also denied the drug manufacturers’ request for a new trial.
