Updating a blog post we brought you previously, a Las Vegas judge is reportedly considering a request to punish the attorneys involved in an ongoing Actos lawsuit for misconduct.
The trial, which as of last week was underway in a Las Vegas district court, involves two residents who claim that they developed bladder cancer after taking Actos.
According to the Las Vegas Review-Journal, last week District Judge Kerry Earley heard arguments from the plaintiffs’ attorney who said that the lawyers representing Takeda Pharmaceuticals were acting disrespectfully in the courtroom.
Earley reportedly has taken issue with the Takeda lawyers, saying that the behavior of the counsel during the trial has been “absolutely very egregious.” She also called the behavior disrespectful.
At one point during the trial, Earley had to reprimand a Takeda attorney for pointing his finger at her. She also admonished another one for rolling her eyes and telling the judge she “was getting emotional.” Earley reprimanded the attorney who rolled her eyes and asked a jury to disregard any gestures made by her in the courtroom.
The attorneys representing the plaintiffs’ said that the defense is acting out in an attempt to get a mistrial.
At the moment, there are thousands of lawsuits pending across the country against Takeda over Actos and bladder cancer. The manufacturer has been accused of failing to inform consumers and doctors about the risks associated with the use of the drug.
It should be noted that in 2011, the US Food and Drug Administration (FDA) issued a safety announcement stating that use of Actos for more than one year may be associated with an increased risk of bladder cancer.
