Judge Upholds C.R. Bard Transvaginal Mesh Verdict

The judge in a C.R. Bard transvaginal mesh lawsuit has upheld a jury verdict awarding a woman $250,000 in compensatory damages and $1.75 million in punitive damages.

On October 18, Judge Joseph R. Goodwin upheld the jury verdict. The lawsuit and verdict was the first federal case involving the Avaulta line of transvaginal mesh products manufactured by C.R. Bard. The award should set a precedent for future cases.

C.R. Bard filed a motion to vacate the jury’s verdict because allegedly insufficient evidence was presented during the trial to substantiate the plaintiff’s claims. However, Judge Goodwin found that Bard failed to conduct human trials before marketing the product for use, and did not warn consumers that the material used in the product was not fit for implantation in humans.

As of November 12, the US Food and Drug Administration (FDA) had received almost 3,000 reports of complications from transvaginal mesh recipients over the last three years. The devices have been linked to vaginal bleeding, discharge and drainage, infections, vaginal mesh erosion and extrusion, sexual dysfunction and scarring.

It should also be noted that as of last month, C.R. Bard Inc., Endo Health Solutions Inc. (ENDP), Boston Scientific Corp. (BSX) and two other companies making transvaginal mesh devices were in talks to settle lawsuits over their products, according to Bloomberg News.
